For the purpose of this Agreement, Bijouterie Lavigueur is referred to collectively as: "We", "Our" or "Us." What We purchase shall be referred to as "jewellery," "Precious Metals," "gold," "content," "goods," "items," or "material".


We purchase Your gold ("Precious Metals") for refining only. The payout value We pay to each Seller is based upon the total weight and purity or karat grade (pure Precious Metal content) contained in the material purchased, and the Precious Metal market value according to the last quotation of the London Fix (the price at which gold and other Precious Metals is set during two daily bidding sessions in London) for the respective Precious Metal on the day Your package is received by Us and logged into Our facility. Any necessary foreign exchange will be calculated using the exchange rate published by the Bank of Canada at closing on the business day prior to receipt of your mailing package and its entry into our system. Notwithstanding the foregoing, the price that We offer to You might not be the current market price of gold or other Precious Metals. Our payout to You is not based on the material's potential value if resold intact. We do not recognize nor pay for any sentimental value, real or perceived. We will not pay for pearls, gemstones, or any other non-Precious Metal material in the jewellery.


Please note that We will only pay You for the Precious Metals in Your goods. We will not pay You for or return to You any non-Precious Metal substances, which includes but is not limited to gemstones, costume jewellery, and plated jewellery. If you wish to remove these gemstones before sending us your precious metals, we recommend it to you. In addition, we will not accept, and we do not offer payment for watches. Clocks or coins which are legal tender and discharge in Canada or elsewhere.


We are compliant with Canada's Proceeds of Crime (Money Laundering) and Terrorist Financing Act. This means that We keep records in accordance with legal requirements and certain transactions may be subject to government reporting.

How do we exchange your precious metals for money?


1- Access Our website. Request a shipping kit and we will send you a package with a tracking number. Your merchandise cannot be purchased without a valid tracking number.


2- Follow the instructions in the kit for sending your gold to us.


3- When we receive your package, you will receive an email confirming the receipt.


4- Your merchandise will be unpacked, weighed, and analyzed to determine its content. Unpacking and weighing will be photographed for your protection.


5- The net value that we offer is based on the last quotation of the current London Fixing for the respective precious metals, on the day that your package is received by us and is registered with our establishment using a label of valid transportation that you have obtained from us. As soon as a value is determined for your merchandise, you will receive an email notification that we have made payment.


If You are satisfied with the payment amount, You need to accept it. If You change Your mind about selling Your goods or are dissatisfied with the amount offered, or if You want to cancel the transaction for any other reason, You may do so at this point by notifying Us of Your intention to cancel the transaction by visiting the Contact Us section of www.lavigueur.com


If You have already received payment and You wish to cancel the transaction, You must return Your uncashed or non-deposited check to Us within 20 calendar days from the date of issuance on the check to the address provided in the Contact Us section of www.lavigueur.com. Upon Our receipt of said payment We will return Your merchandise to You.


If we do not receive the return of payment within 20 days of the date it was issued, we will consider you have accepted the payment offered, the transaction will be final and the merchandise will be processed for refining.


Notwithstanding the foregoing if your payment is cashed or deposited in a bank or other financial institution, this will constitute your acceptance of our payment offer, the transaction will be considered final and completed and the merchandise will be processed for refining.


Requirements for Participation


You must be at least eighteen (18) years of age (residents of Alberta, Saskatchewan, Manitoba, Ontario, Quebec and Prince Edward Island) and at least nineteen (19) years of age (residents of the rest of Canada) in order to sell jewellery or other Precious Metal items to Us. In addition, You must provide Your name, address, telephone number and e-mail address. No P.O. Box address is acceptable. We will only ship to a Canadian address. You must be the legal owner of all Precious Metals, jewellery, or other property sold or attempted to be sold to Us, and You must have absolute authority to sell that merchandise and must be acting on Your own behalf and not as an agent or representative of any other person or any company. We may request documentation of proof of identity, age, or ownership.


By shipping your merchandise to us, you indicate that you are the legal owner of it and that you have absolute authority to sell merchandise being shipped and that you agree to all of the terms set out below and those described on our website, which are subject to change, without notice. You indicate that the number of your driver’s license or other government identification document that you provide to us is true and correct.


Guarantee Against Loss


We do not assume any responsibility for the loss of your merchandise until it has been delivered to us and entered into our control system, in accordance with the guidelines established by us and on the terms herein. We reserve the right to refuse delivery of any mail, envelope or package which appears damaged, opened, or handled and it will be returned to the customer by the postal service or the courier service. We will have no liability to any customer for the attempted delivery or return of any item.


Limitation of Liability - General


This limitation of liability shall be binding on every Customer and on any third party, including, but not limited to, the Customer and the Customer's successors, assigns, insurance carriers and any other individual or entity asserting any right or claim relating to the Customer's transaction with Us.


No Liability for Property in Our Possession: In no event shall We be liable for any damages from the loss or destruction of property in Our possession for any reason - including negligence - except as stated in this Agreement. In no event shall We be liable to any third party, including any insurance carrier, nor shall We be liable for any subrogation claim brought by the Customer's insurance carrier. By submitting an item to Us, the Customer expressly and specifically waives any such subrogation claim on his or her behalf, as well as on the behalf of his or her insurance carrier.


Limitation of Liability Regarding Goods Shipped to Us


We shall not assume any liability for the loss of Your goods until they have been received by Us and logged into Our facility, using a valid shipping label obtained from Us. Your goods must be shipped to Us using the carrier indicated by Us. Your goods will be insured with the carrier for a maximum value of ONE HUNDRED DOLLARS ($100). Claims for any losses that occur during shipment to Us must be made directly with the carrier and/or its insurance company. It is Your responsibility to ensure that the carrier has electronically scanned and accepted possession of Your package into their tracking system.


Limits of Liability Regarding Goods Returned to You


Any merchandise returned to you will be insured for the value of the precious metal including ONLY, as we shall determine, up to a maximum of FIVE HUNDRED DOLLARS ($500), with no acknowledgement for the potential value of the item if resold intact, nor for its sentimental value, nor for other factors or causes. In the event of loss or damage to your goods in transit to you, our liability will be limited to the insured value of your goods as we have insured, up to a maximum value of FIVE HUNDRED DOLLARS ($500).


No other liability: we will not be liable to anyone for any loss of profit, opportunity, incidental, indirect, or punitive damages. By submitting your merchandise to us, you explicitly accept this limitation of liability.

The United Nations Convention for the International Sale of Goods shall not apply. Our failure to exercise or enforce any right or provision of the Agreement will not be deemed a waiver of such right or provision. If any provision of the Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Agreement shall remain in full force and effect. You agree that, regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the services offered by Us must be filed within one (1) year after such claim or cause of action arose, or be forever barred. Subject to any applicable law, any such claim or cause of action must be filed in the courts of the Province of Quebec, district of Longueuil. Each party consents to the venue and jurisdiction of said courts. You shall indemnify Us for any and all costs incurred by Us in defending any civil action filed by You or on Your behalf, or attempted to be filed by You or on Your behalf, in any jurisdiction outside of Longueuil, Quebec, including but not limited to, attorneys' fees incurred by Us. You hereby expressly waive any right to trial by jury.


Indemnity


You agree to indemnify and hold Us, Our subsidiaries, affiliates, and licensors and their respective officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Your use of Our website, or its content in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of Your representations and warranties set out herein.


Independent Contractors


Nothing in this Agreement shall be deemed to create an agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship of any kind between Us and You.


No Third Party Beneficiaries


This Agreement is between You and Us. There are no third party beneficiaries to this Agreement.


Assignment


You may not assign Your rights under this Agreement to any third party; We may assign Our rights under this Agreement without condition.

2. What type of precious metals can I resell?

Bijouterie Lavigueur will offer you the opportunity to buy your gold jewelry only. We do not buy stones, whether real or synthetic. However, for diamonds, we may make you an offer to buy them at the same rate as the price of gold.

3. Can I bring my gold to one of Bijouterie Lavigueur stores instead of sending by mail?

Of course, you can go to one of our branches neasrest you to have your gold jewelry appraised. Our service is reliable, without an appointment and always free. Whether in-store or online, you will have the peace of mind of having your old gold jewlery that is lying needlessly in your jewelry chest. It’s easy to convert your jewelry into money.

4. What kind of items that you buy?

We will only pay for items that are made of gold, regardless of its color (yellow, white, pink) and purity (10k, 14k, 18k). We will not pay for gold-plated jewelry, silver or platinum.


5. What should I do if the jewelry I want to resell is set with diamonds or other gemstones?

It should be noted that in store or online, our evaluation will be based solely on the gold value of the jewelry you wish to dispose of. Therefore, we cannot return or pay for other precious metals that are alloyed in your jewelry. We do not buy stones, whether real or synthetic. For diamonds, except if they are of good quality, we may make an offer to purchase. Please note that the price of gold is currently higher than the value of the diamond fragments that are set as pave on your jewelry. We could buy these small stones by weighing them with your jewelry. Instead of buying them individually, we would buy them as a whole for the price of gold. This way, we will send you an offer to purchase including the gold value of your jewels and stones. We therefore advise you not to dismantle diamonds, but it is up to you if you wish to remove these gemstones before sending us your gold jewelry.


6. How do I get a shipping kit if I want to send my jewelry by mail?

It is very simple. Just fill out the online form on our website. An email will immediately be sent to our Gold Exchange service to activate your order. Our team will send you the shipping kit, which is free of charge, to the address indicated in your request.

7. What's in the shipping kit?

This kit contains instructions (list of jewelry to send and a contract to sign), a bag to put your jewelry and a prepaid envelope with a designated tracking number so you can safely ship your jewelry to our head office.

8. How many items can I send you?

It is up to you to send us as much jewelry as the bag can hold.

Please note that we are in compliance with Canada’s Proceeds of Crime (Money Laundering) and terrorist financing Act. As such, we are required to maintain records in accordance with the requirements of the Act. Certain transactions may be subject to government reporting.

9. Which carrier should I use to ship my jewelry to your head office?

Bijouterie Lavigueur Ltée offers you an easy, free and secure shipping process. Once you order a shipping kit, we will send it to you within five business days (Monday to Friday, 8:00 am to 5:00 pm, except holidays). Simply bring the prepaid envelope from Canada Post. Afterwards, you must bring the envelope containing your jewelry to a Canada Post office. The address of our head office in Saint-Hubert is written beforehand on the prepaid envelope.

10. Can I use my own envelope and / or choose another carrier?

No. It is mandatory to use Canada Post to ship your jewelry to our head office. You must use the prepaid envelope provided with the shipping kit. The shipping of this envelope is at our expense. The use of this envelope allows you, just like us, to track your package.

11. Will my jewelry be insured?

Yes! Bijouterie Lavigueur Ltée will insure all items you send us up to 100$. If you decide to cancel your transaction after shipping your precious metals, we will insure your return package up to a maximum of 500$ based on our valuation of your precious metals only.

12. Once my kit has been shipped, how can I be sure you received it?

We will send you an email informing you that the package has arrived at our head office. You can also track the parcel on the Canada Post website.

13. How much money can I receive from Bijouterie Lavigueur for my items?

Each item you send to us is valued based on a combination of weight, purity and market value of your precious metals. This value will be received at our head office. Our offer is not based on the potential value of the material if it is resold intact. In addition, in our offer to purchase, we do not pay any sentimental, real or perceived value on your jewelry. Bijouterie Lavigueur Ltée offers the best price for the gold of your jewelry. We are convinced that you will be satisfied as much by our offer as by our professionalism.

14. When will I know the value of my precious metals?

As soon as our experts complete the evaluation, and a value of your jewelry is determined, we will send you an offer to purchase by email. If you accept our offer, a cheque payable to your name will be issued immediately, within 48 hours on business days (Monday to Friday, 8:00 a.m. to 5:00 p.m., except holidays).

The cheque will be sent to your address or to a Bijouterie Lavigueur branch nearest you. You will determine this choice when you accept our offer to purchase.

15. What happens if I am not satisfied with the valuation of my jewelry?

If you are not satisfied with our offer, you can refuse it by replying to our email. Your customer area on our website allows you to communicate directly with our team. You can also send us an email to rachatdor@lavigueur.com

In the event that you decline our purchase offer, we will return your jewelry by our internal carrier to our nearest branch. The choice to return your jewelry by our own courrier is preferred to ensure the security of your jewelry. The return of your jewelry via our branch is free of charge. Once we receive your package, our representatives will contact you by phone. A valid identification (driver's license or health insurance card) is required when you prsent yourself to pick up the package.

However, if you wish to have your jewelry sent directly to your home, simply contact us at the specified email indicated. In this case, the package will be sent to a Canada Post office near you. At the postal counter, you will pay the shipping cost before you pick up the package.

16. What happens if I change my mind, but the cheque is sent?

If you change your mind after accepting our offer, you have 24 hours to notify us before your jewelry is melted down. This delay will be based on the time we received your confirmation to accept our offer.

If a cheque is mailed to you, you must return your uncashed / undeposited cheque within 20 days of the date of issue. Please return the cheque by mail, at your expense, to the following address:
